Sotomayor overturned in Ricci v. DeStefano

I know our dear president wanted her confirmed before this ruling, but that’s the way the cooking crumbles. Will she still be a slam dunk with such an obvious miss? You betcha.

From the LA Times:

“No individual should face workplace discrimination based on race,” said Justice Anthony M. Kennedy…

Now wouldn’t that be a great idea for America.

    I predict the left will not comment on Sotomayer’s ‘creative’ decision in ‘Ricci’ but rather blame the decision on the current Court because of the Bush appointees. They will do this because Sotomayer’s decision has absolutely no legal basis to make an argument even though the vote was 5-4.
    However, it is not surprising that our President nominated a racist to the Court since he appointed a tax cheat to head the IRS.

  2. Let’s see…The Court of Appeals ruling was unanimous and the SC ruling was 5-4. I’d say that’s hardly a direct hit on the nominee.

    Thank you Cindy– My vagabond days are over but it was a real treat to travel with a national concert tour. I went to 64 cities all over and am still tingling from the excitement.

    You mean the unsigned (very unusual), un-commented on opinion by three moderately liberal judges which was code for please pass this along the line to the SC. Obama was obviously proud as Sotomayor essentially voted ‘present’. None of the tough legal issues were commented on at all by the appeals court.
    Not to worry, she’ll be approved.

    Yes grumps, that is a hard hit directly on the nominee, in this case, a racist foreign woman who leveraged her affirmative action cakewalk at Yale into a powerful position where she could assert an employers right to make employment decisions. It is so sad.
